Buyer's Real
Estate Agency Disclosure
Effective January 1, 1994
According to ORS Statues 696.820 - 696.830 (Senate Bill 1097)
Under the law of agency, state laws, and the National
Association of Realtors® Code of Ethics, real estate agents
have certain duties to their principles and other parties in a
transaction, which are described below. Those duties, however,
do not remove you from the responsibility to protect your own
interests. Read carefully all agreements to ensure that they
adequately express your understanding of the transaction. A
real estate agent is qualified to counsel you on matters
concerning real estate. If legal or tax advise is desired
consult a competent professional in that field.
Generally a real estate agent represents either the Seller or
the Buyer. Due to the many relationships which can exist
between you and a real estate agent it is important that you
read and understand the following information.
Seller's Agent's Duties
A listing agent represents the Seller by contract and law, and
must act in the best interest of the Seller.
A fiduciary duty of utmost care, integrity, honesty,
confidentiality and loyalty in dealing with the Seller. The
broker and or their agents, may never disclose confidential
information to a Buyer, such as the price a Seller may be
willing to accept.
The duty to comply with a Seller's lawful instructions.
The duty to account to the Seller for funds held for the
benefit of the Seller.
The duties discussed below under Agent's Duties to all
Parties.
The duty to comply with Fair Housing Laws.
Buyer's Agent's Duties
A buyer's agent represents the Buyer only, and must act in the
best interest of the Buyer.
A fiduciary duty of utmost care, integrity, honesty,
confidentiality and loyalty in dealings with the Buyer. The
broker and or their agents, may never disclose confidential
information to a Seller, such as the price a Buyer may be
willing to pay.
The duty to comply with a Buyer's lawful instructions.
The duty to account to the Buyer for funds held for the
benefit of the Buyer.
The duties discussed below under Agent's Duties to all
Parties.
The duty to comply with Fair Housing Laws.
Agent's Duties in a Limited Agency Relationship
In-Company Sale Only
It is the policy of Blue Ribbon Real Estate, Inc., not to
enter into a Dual Agency Relationship with the Seller and
Buyer on an In-Company sale, because "Dual Agency" could
create conflicts of interest. However, with prior written
approval/and consent of the Seller and Buyer, Blue Ribbon Real
Estate, Inc., may enter into a Limited Agency relationship for
an In-Company transaction. By taking this position between the
parties, confidential information will remain confidential.
The material and disclosure information concerning the subject
property remains the same.
The Broker/Agents have the following responsibilities to both
Seller and Buyer:
A fiduciary duty of utmost care, integrity, honesty,
confidentiality and loyalty in dealings with both the Seller
and the Buyer. The broker and or their agents, may never
disclose confidential information to the Seller, such as, but
not limited to the price a Buyer may be willing to pay or
disclose confidential information to a Buyer, such as, but not
limited to the price a Seller may be willing to accept.
Agent's Duties to All Parties
Diligent exercise of reasonable skill and care in performance
of the agent's duties.
The duty of "Honest and fair dealing" and good faith.
The duty to disclose all facts materially affecting the value
or desirability of the property known to the agent.
The duty to present all offers promptly.
The duty to comply with Fair Housing Laws. |
